Specialised companies that deal with industrial site remediation fully understand that, on properties often abandoned for a long time without maintenance, they may encounter critical situations in terms of safety. One of the most common cases is discovering large quantities of old drums filled with hazardous material, stacked or otherwise stored too long in non-ideal conditions, which, due to wear or accident, are damaged and have begun to leak. This is an immediate problem in terms of environmental protection and public health, because such spills inevitably infiltrate the soil, contaminating it; on the other hand, rightly, regulations prevent moving damaged drums, which could pose a serious hazard, and therefore transporters refuse – also in order not to incur criminal liability – to move them. Since it is not possible to transfer hazardous content of defective drums into new healthy drums, one needs a different solution. All of this must also be carried out in full compliance with the regulations of the ADR agreement.

Since 1957, the ADR regulations – regularly update – have formed the foundation for the regulation of road transport of all types of dangerous goods across Europe. They involve all actors engaged in the transport chain (shipper, carrier, and recipient). By establishing precise rules for packaging, documentation, and means of transport, depending on the type of dangerous goods being handled, the ADR framework aims to ensure that road transport of hazardous materials is safe, controlled, and standardized. This is achieved both by reducing the probability of incidents and by defining the procedures to be followed in case such incidents occur. The types of issues we have described correspond precisely to the situations addressed in Parts 4 and 6 of the ADR regulations, which govern the requirements for packaging and overpacks – devices designed to contain damaged drums and prevent the release of hazardous substances. These allow transport to continue without requiring the transfer of contents (which, under the described conditions – such as transport on the road – would not only be risky but potentially unachievable). In doing so, they form a new transport unit that complies once again with ADR standards.
